Terms of Service

These Terms of Service govern your use of the OpenArt Android application and related services. By downloading, accessing, purchasing, or using OpenArt, you agree to these Terms. If you do not agree, do not use the app.

1. OpenArt service

OpenArt provides AI-assisted creative tools for generating, transforming, and recreating photo and video content. Features, models, templates, output quality, generation limits, processing times, and availability may change over time.

2. Eligibility

You must be legally capable of agreeing to these Terms under the laws that apply to you. If you are below the age at which you can enter into a binding agreement, a parent or legal guardian must authorize your use where permitted by law.

3. Your content and instructions

You retain whatever rights you lawfully hold in prompts, images, video, or other material you submit to OpenArt. You grant OpenArt and its service providers a limited right to host, transmit, reproduce, modify, and process that content only as reasonably necessary to operate, secure, maintain, and provide the requested services and as otherwise permitted by the Privacy Policy.

You represent that you have all rights and permissions necessary to submit your content and to request the intended generation or transformation.

4. AI-generated output

AI-generated content may be inaccurate, unexpected, incomplete, or similar to content generated for other users. OpenArt does not guarantee that an output is unique, accurate, suitable for a particular purpose, non-infringing, or eligible for intellectual-property protection. You are responsible for reviewing outputs and for how you use, publish, distribute, or commercialize them.

5. Prohibited use

You may not use OpenArt to violate law or the rights of others; infringe intellectual-property, privacy, publicity, or other rights; impersonate or deceive others unlawfully; distribute malware or interfere with the service; attempt unauthorized access to systems or models; bypass technical limits or payment requirements; automate abusive traffic; or create or distribute content that is unlawful to possess or distribute.

6. Subscriptions and Google Play billing

OpenArt may offer paid subscriptions or other paid access through Google Play. Prices, billing periods, trials, renewal information, and included features are shown in the app or Google Play purchase flow before you confirm a purchase.

Subscriptions purchased through Google Play are billed to your Google Play account and may automatically renew unless canceled in accordance with the terms shown by Google Play. You can manage or cancel eligible subscriptions through your Google Play account. Refunds are handled according to applicable law and Google Play's refund rules unless OpenArt expressly provides otherwise.

7. Credits, limits, and access

Some generations or features may use credits, usage limits, subscription entitlements, or other access controls displayed in the app. Such limits may vary by feature, model, resolution, generation type, subscription, or technical availability. Unless required by law, unused promotional access or non-monetary usage allowances have no cash value.

8. Availability and changes

OpenArt may add, remove, suspend, or modify features, models, templates, limits, and technical requirements. Service interruptions may occur because of maintenance, third-party providers, network conditions, model capacity, security events, or circumstances outside OpenArt's reasonable control.

9. Intellectual property

The OpenArt app, software, interface, branding, compilation of templates, and related materials are protected by applicable intellectual-property laws. Except for the rights expressly granted in these Terms, no license or ownership right in OpenArt's software or branding is transferred to you.

10. Feedback

If you voluntarily provide suggestions or feedback about OpenArt, you permit OpenArt to use that feedback without restriction or compensation, provided this does not grant OpenArt ownership of your separately submitted creative content.

11. Third-party services

OpenArt depends on third-party platforms and service providers, including Google Play and providers involved in hosting or AI processing. Your use of third-party services may also be subject to their own terms and policies. OpenArt is not responsible for a third party's independent services or conduct.

12. Suspension and termination

OpenArt may limit, suspend, or terminate access when reasonably necessary to address unlawful use, abuse, security risks, violations of these Terms, nonpayment, or legal requirements. You may stop using OpenArt at any time and may cancel subscriptions through Google Play where applicable.

13. Disclaimers

To the maximum extent permitted by law, OpenArt is provided on an “as is” and “as available” basis without warranties of uninterrupted availability, error-free operation, merchantability, fitness for a particular purpose, or non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of liability

To the maximum extent permitted by applicable law, OpenArt and those involved in providing the service will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the service. Any limitation applies only to the extent enforceable in your jurisdiction.

15. Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of OpenArt, your violation of these Terms, or content you submit in violation of another person's rights.

16. Governing requirements

These Terms are subject to mandatory consumer-protection and other laws that apply to you. Nothing here is intended to waive rights that cannot legally be waived. Because no specific governing jurisdiction or business legal entity was provided for this site, these Terms do not invent one; applicable jurisdiction will therefore be determined under relevant law.

17. Changes to these Terms

OpenArt may update these Terms to reflect changes in the service, law, subscriptions, providers, or business practices. The effective date will be updated when a revised version is published. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
